Event Agreement, Liability Waiver & Photo/Video Release

1. Event Details & Booking Policy

Thank you for choosing Foamify Foam Parties LLC ("Foamify") for your event.

To reserve your event date:

• Booking requests are subject to review and approval.

• Event dates are not guaranteed until a required deposit is received.

• Remaining balances are due 72 hours prior the event date unless otherwise agreed in writing.

• Deposits are non-refundable unless otherwise specified by Foamify.

2. Weather Policy

Foamify operates outdoors and weather conditions may impact service.

Foamify reserves the right to postpone or reschedule an event due to:

• Lightning

• Severe weather

• High winds

• Unsafe conditions

• Equipment safety concerns

If an event is postponed due to weather, Foamify will work with the customer to reschedule based on availability.

3. Foam Safety Acknowledgment

Customer understands and acknowledges:

• Foam solution used by Foamify is professional-grade, non-toxic, and hypoallergenic when used as intended.

• Foam is designed for entertainment purposes only.

• Foam may create slippery conditions on certain surfaces.

• Running, horseplay, pushing, rough play, diving, or unsafe activity inside foam areas can increase the risk of injury.

• Bare feet or appropriate footwear are recommended.

• Foam should not intentionally be placed in eyes, mouths, ears, or consumed.

Customer agrees to immediately report any safety concerns.

4. Supervision Responsibility

Customer agrees:

• A responsible adult must remain present and supervise participants at all times during the event.

• Foamify employees/operators are responsible only for operating equipment and providing entertainment services.

• Foamify employees are not responsible for the supervision of children.

5. Equipment Protection

Customer agrees to ensure guests do not:

• Climb on equipment

• Pull hoses

• Tamper with equipment

• Intentionally damage any Foamify equipment

Customer may be responsible for repair or replacement costs resulting from intentional damage, misuse, vandalism, or negligence.

6. Assumption of Risk & Release of Liability

I understand that participation in a foam event involves inherent risks, including but not limited to:

• Slips

• Falls

• Collisions

• Minor injuries

• Risks associated with physical activities

• Risks associated with water activities

I voluntarily assume all risks associated with participation.

To the fullest extent permitted by law, I release and hold harmless:

Foamify Foam Parties LLC, its owners, employees, members, contractors, and representatives from any and all claims, injuries, losses, damages, expenses, or liabilities arising out of participation in the event, except where prohibited by law.

This release applies to myself, my family members, participants, guests, and minor children attending the event.

7. Photo & Video Release

I grant Foamify Foam Parties LLC permission to photograph and/or record video during the event.

I understand these images and videos may be used for:

• Social media

• Website content

• Marketing materials

• Promotional advertisements

• Printed materials

• Future business promotion

I understand I will receive no compensation for use of these images or recordings.

8. Customer Acknowledgment

I certify that:

• I am at least 18 years of age.

• I have read and understand this agreement.

• I voluntarily agree to all terms and conditions.

• I understand this document contains a release of liability and legal rights.
